What is "Operational Commencement" and Direct Community Impact payments for Police and Fire

 


Exhibit A. Direct Community Impact Payments.
   Before discussing the 9 firefighters and 9 police officers, along with training and equipment additions, there are additional concerns I have on other issues…..Before the Impact Payments payments for Police and Fire are to begin “no later than 12 months before…”…I’m trying to wrap my head around the timing aspects.
    …Hold on and try to follow…. “No later than 12 months prior to Anticipated Operation Commencement.” “Operation Commencement means that the Casino, the Hotel Component and Parking Component are “complete” and open for business to the general public.” “Complete” means ”the substantial completion of work….not less than 75% of Parking Structure…not less than 75% of Gaming Area…75% of Hotel rooms…50%…retail space…50% ….restaurant floor space…(the last 2 can be completed as shells and available for leasing)(see def. of complete). “Construction Completion Date…date no later than____months…”after state issues Category 1 license….Date to be filled in later. “Final Completion Date…no later than 6 months following….Construction Completion Date….” Check all the definitions in the Agreement…. Somebody do a matrix to explain this to me…..
      Based on all this…the “ Sec. 1 Upfront Direct Impact Payments” for Police and Fire, might as well be promoted to the “Sec. 2 Interim Payments” option and should start before construction begins. All these roadway, water, and sewer projects will be ongoing at the same time. Review time for federal and state approvals and construction will probably take 3-5 years. Construction will probably be 24 hours as 495 work should be at night to reduce traffic impacts. Both Police and Fire should expect increased service calls due to accidents and traffic congestion. New hires for both departments should be available for entire construction process, and not just up to 12 months prior to opening...
