Knife-Fight Defendants Ordered Held

Two men accused of attacking another man at the Valero gas station July 31 will be held without bail until a pretrial hearing Sept. 26.

A District Court judge ordered two men accused in a knife-attack at the property in Milford held without bail, following a "dangerousness hearing" Thursday.

The decision by District Judge Robert Calagione followed a brief hearing in which a state prosecutor submitted police and witness statements, documents that were challenged by two defense attorneys as offering incomplete, inconsistent information.

Assistant District Attorney Bob Shea said: "By way of their actions, they presented themselves as a danger to the community."

20, of 18 Taylor St., Milford, 20, is charged with assault to murder, assault with a dangerous weapon and armed assault to murder.

, 25, lives at 19 Taylor St., Apt. 1, Milford. His last name initially was misidentified in arrest records. He is charged with assault to murder, assault with a dangerous weapon, armed assault to murder and assault and battery with a dangerous weapon.

The two men stood side-by-side in the room Thursday, and said nothing at the hearing. Their attorneys argued they should be eligible for release on bail.

"The police reports are replete, I would submit, with inconsistencies," said Framingham attorney Charles Hughes, who represents Do Amaral. Hughes also objected that no witnesses attended the hearing, which would have allowed him to question them.

Attorney Mike Foglia, who represents De Oliveira Godoy, said his client has no prior criminal record, has the support of family and church members, and is employed as a carpenter. He is a responsible member of the community, Foglia argued.

"He is a simple, hardworking guy . . . working as much as he can and staying out of trouble."

According to the attorneys' comments in court, both men deny bringing the weapon, and dispute who brandished it during the altercation.

The assault was reported July 31, outside the Valero gas station. The victim told police he confronted the two men when he saw them entering the store, and saw a knife. Milford police later determined the man owed De Oliveira Godoy money, which the latter was trying to collect, according to a police press release.

The victim fled in to the Valero convenience store, and entered the bathroom, to from his attackers, he told police.

In the fight, the victim sustained a minor injury that did not require medical treatment. Police apprehended Do Amaral a short time later, after finding him hiding nearby. De Oliveira Godoy turned himself in two days later.

Both are next scheduled to appear in court on Sept. 26 for a pretrial hearing.
